Terms and Conditions are an important part of any business transaction. They set out what you can expect from your service provider, and what your service provider expects from you. Please take 5 minutes to read through the T&C’s for Filby Driver Training, and feel free to ask any questions.
Terms and Conditions of Business Filby Driver Training - hereafter referred to as “FDT” LICENCE: On commencement of training, all trainees must be in possession of a current Full or Provisional Licence. INSURANCE: Provided the client is licenced to drive, all fees include client cover whilst driving the training vehicle. Clients must be accompanied by either a DVSA Approved Driving Instructor, or an approved DVSA Examiner. FITNESS TO DRIVE: In accordance with the Drug Driving laws, March 2015, prior to commencing a lesson you, the client, must advise your instructor of any medical condition you may have, or ANY substance you have taken which could impair your ability to drive. Your instructor will ask you to confirm your continued fitness to drive at the start of each lesson and record your answer. Where there is any doubt, either on the part of the client or the instructor, “FDT” reserves the right to cancel the lesson. Similarly, where there is an obvious and clear impairment, the lesson will not go ahead.  Where ANY doubt exists regarding your fitness to drive, consult your doctor. Where doubt exists concerning an individual’s fitness to drive, which results in the cancellation of the lesson, the full lesson fee remains payable. CANCELLATION POLICY: Where a lesson needs to be cancelled by the client, irrespective of the reason, 48 hours notice is required. Where a cancellation is received with less than 48 hours notice, the full lesson fee will remain payable. Where lessons have been pre-paid and the required cancellation notice is not given, the lesson fee will be deducted from the credit balance. Where short notice cancellations become routine “FDT” reserves the right to withdraw service without notice. Any exceptions are entirely at the discretion of your instructor. Where your instructor has to cancel a lesson, except for adverse weather or mechanical failure, and 48 hours notice is not given, your next lesson will be provided free of charge.   LESSON PRICES: Details of current tuition fees and driving test day fees can be found on our website. Reduced price initial hours valid for 30 days of date initial written email confirmation. LESSON PAYMENTS: Payment is accepted either by cash or electronic bank transfer. No cheques, debit or credit cards. If payment is by cash, the lesson fee is to be paid in full at the start of the lesson. If the client needs to use a cash dispenser, they must make this known at the start of the lesson, and this will form part of the lesson time. If payment is by internet transfer, the full amount is to be transferred 24 hours prior to the     lesson. WHERE THE LESSON FEE IS NOT RECEIVED IN ACCORDANCE WITH THE ABOVE TERMS, “FDT” RESERVES THE RIGHT TO CANCEL THE LESSON. “FDT” does not provide credit facilities for any reason, under any circumstances, at any time. Where a client pre-pays for a block of 10 hours, if, for any reason whatsoever, the client wishes to cease lessons, the remaining balance will be refunded in full upon receipt of 48 hours written notice of cancellation. SCHEDULING LESSONS: Lessons are booked in accordance with a client’s payment preference. So, if a client pre-pays for a block of 10 hours, this amount of time will be forward booked. Where a client chooses to pay weekly, lessons will be booked a maximum of one week ahead. Please bear in mind that with weekly booked lessons, lesson day and time cannot be guaranteed. THE DRIVING TEST: “FDT” reserves the right to withhold use of the training vehicle if, in the Instructors opinion, the client has not reached the required standard. “FDT” charges £80 for use of the tuition vehicle on test day. This fee includes a one hour lesson prior to your test, use of the tuition vehicle for the duration of your test, debrief and return travel to the original pick up point. Any additional lesson time required prior to the test, over and above the inclusive hour, will be charged at the prevailing standard hourly rate Your DVSA test fee is payable separately when booking your test online. “FDT” test day fees are payable in cash prior to the start of your test, or online 24 hours prior to your test. “FDT” cannot be held responsible for Test Appointments being postponed or cancelled by the DVSA for any reason. “FDT” is not responsible for any failure of light bulbs etc. during the Practical Test.  All bulbs / lights etc. will be checked with the candidate prior to commencement of the test. “FDT” cannot be held responsible in the event of mechanical breakdown prior to, or on the day of a driving test. Such circumstances cannot be foreseen, however, “FDT” will make every effort to obtain a replacement vehicle. If unable to do so, “FDT” will refund the cost of the DVSA Practical Test  fee only. Where a client is advised of any mechanical failure, and there is sufficient time to cancel / reschedule the test to avoid financial loss, but the client chooses not to do so, “FDT” will not refund the DVSA Practical Test Fee in these circumstances. PERSONAL ITEMS: “FDT” will not accept responsibility for damage or marking to clothing as a result of coming into contact with areas of the vehicle subjected to road dirt, brake dust, mechanical oils or grease - including the Show Me, Tell Me section of the course or Practical Test. This may involve lifting the bonnet for which disposable gloves are provided if required. “FDT” accepts no liability for personal property that is left in the training vehicle or lost at any point during the course of a lesson. LINKS TO THIRD PARTY WEBSITES: Our website may include links to third party websites that are controlled and maintained by others.  Any links to other websites is not an endorsement of those websites and “FDT” is not responsible for the content or availability of such websites. HEALTH AND SAFETY: “FDT” operates a strict no smoking policy. By law, the training vehicle must be maintained as a smoke free environment. No exceptions at any time. Mobile phones off or silent. No exceptions. SPECIAL OFFERS: Special Offers are provided entirely at the discretion of “FDT” and can be changed or withdrawn at any time and without prior notice. “FDT” reserves the right to withdraw any special offer terms where tuition fees remain unpaid. Any special offer is to be used within 30 days of commencing your driving course, otherwise it is forfeited and the prevailing standard hourly rate will apply. If a client switches to “pay as you go” on expiry of a block booking discount, the standard hourly rate will apply. Introductory reduced price hours are to be taken in blocks of 2 hours. For example, an offer of first 4 hours at a reduced rate must be taken in 2 blocks of 2 hours, and within 30 days of commencing training. MOTORWAY TUITION: From 4th June 2018 learner drivers are permitted to use the motorway network for training. Training must take placed with an Approved Driving Instructor, in an identifiable learner vehicle, which must be fitted with dual controls, and suitably insured to include motorway training. Motorway training is priced separately from standard lessons. See website for details. Motorway training will be arranged as a standalone lesson, minimum 2 hours. It will not be included as part of normal lessons. DATA PROTECTION: Filby Driver Training is registered with the Information Commissioners Office, in compliance with the revised GDPR EU laws on Data Protection, effective 25th May 2018. My registration date was 9th April 2018, and is required specifically in relation to the use of dash cams within the tuition vehicle. Data Protection - Dash Cam Use Filby Driver Training uses dash cams in both the front and rear windscreens of the tuition vehicle. These are outward facing and record sound. There is no internal view of the vehicle. The cameras are used exclusively for the safety and security of the occupants of the tuition vehicle. The memory cards are formatted at the end of each day. No video footage is retained beyond the end of the tuition day. The contents of a memory card would only be released to either the Police or to an insurance company to establish liability in the event of an incident. Data Protection - Other Filby Driver Training takes your privacy very seriously. We respect your personal information and we do not share client’s information with 3rd parties for any marketing purposes. Basic client information is held both in paper and electronic formats (accounts spreadsheet and email). We hold members, name, postal address, email address, driving licence number, mobile or landline phone numbers, and licence check details. Information is held on a password protected laptop, which is stored securely. Broadband is also password protected. Client information, together with payments made must be retained for 7 years to comply with HMRC audit requirements. After 7 years, all electronic and paper information is deleted and / or destroyed. We will only contact you by phone, text or email if relevant to your course of lessons. We do not send unsolicited mail of any kind at any time. Covid-19 Additions to Standard Terms and Conditions The following is in addition to my standard Terms and Conditions, and will remain in place for as long as Government guidelines on driving lessons dictate necessary. These Terms and Conditions may be varied from time to time, as Government advice changes. Where any of the Covid-19 Terms and Conditions conflict with others contained in the main document, the Covid-19 T&C’s shall take precedence. Lessons are provided on the basis and understanding that no working environment can ever be 100% risk-free, and the client accepts the risks associated with undertaking a lesson, and the precautions put in place by Filby Driver Training are a “best endeavours” approach, and based on issued Government guidance. · All new clients must make known any medical condition which is reportable to the DVLA, and which would prevent them from safely undertaking driving lessons. In such circumstances, lessons will not be offered. · Confirmation of a lesson will be texted 24 hours ahead of the scheduled time. The pupil must reply confirming the following: o Neither they, nor anyone in their household has displayed any of the Covid-19 symptoms in the previous 7 days or have been in contact with anyone who has had the symptoms within the previous 14 days. · They are not living in the same household as someone who is shielding i.e. an extremely clinically vulnerable person. o If the answer is “yes” to any of the above, the lesson will not take place, and the pupil will be expected to self-isolate in accordance with Government guidelines. Where a lesson is cancelled due to Covid-19 symptoms, NO cancellation charge will apply. o The symptoms are: high temperature, new, continuous cough, loss of taste and / or smell. · The instructor will meet a pupil at the car, and not at their house. · Immediately prior to commencing the lesson, the instructor will ask the pupil to confirm they have washed their hands, and that they remain free of symptoms. · Face coverings are to be worn by both Instructor and client throughout the entire lesson. o These must cover nose and mouth and are intended to minimise the wearer passing on any infection, not to prevent catching an infection. o If a client is unable to wear a face covering due to a medical condition e.g. asthma, then no lesson will not be offered. o If a client is unwilling to wear a face covering through personal preference, no lesson will be offered. · For additional safety, disposable gloves are preferable, but not mandatory, however, the pupil should bring hand sanitiser with them for frequent use throughout the lesson. · For new clients, licence checks will be done electronically, ahead of the first lesson. The pupil still needs to bring their licence for verification of ID, but the instructor will not touch the licence. · If the pupil wishes to make notes, they must bring their own pen and notepad. · The instructor will maintain sole control of any stationery, pens, briefings etc, and these will not be handed to the pupil. · Where a demonstration is required, and seats are swapped, the pupil will be required to wipe down the controls when they resume the drivers seat. · Due to the lack of social distancing, instructor and pupil will face forward to avoid direct face to face contact. · There will be no physical contact throughout the duration of the lesson e.g. handshakes. · The vehicle cockpit will be cleaned between each lesson with bleach free anti-bacterial cleaner. Similarly, exterior door handles. · As far as is practical, given weather conditions, windows will be partially down to allow a free flow of fresh air. Air conditioning will not be used during a lesson. · Payments are preferred by bank transfer, 24 hours ahead of the lesson. · Cash is acceptable, however, the correct money must be bought to the lesson as the instructor will not carry change. Any cash will be placed in an envelope and sealed.  June 2020
